By choosing ASD, you as the Client, agree to these terms and conditions*
domain name registration & hosting
ASD will secure domain names and/or hosting accounts on ASD servers for Client at Client’s request. If Client desires a specific domain name that is already owned by another party, negotiations the domain name must be undertaken by Client.
authorization
Client agrees to provide ASD with access to their domain and hosting accounts and any other files and programs pertaining to the web site (re)design project.
work specification
ASD will submit a Service Agreement, which outlines the scope of work, the specifics of our agreement, components for the web site (re)design, total cost and a payment schedule. Changes or additonal work not covered in the Service Agreement is considered outside the scope of work. ASD will provide Client with a revised Service Agreement reflecting these changes/additional work and the appropriate fees for said work.
communication & completion
The majority of communication is done via email or Skype (text chat) unless prior arrangements are made with and approved by ASD. Phone calls or video Skype sessions are available to Client and billed at ASD’s hourly rate.
Web site (re)design: When ASD and Client begin their project, Client will be available for questions, feedback and complete tasks throughout the process to keep the completion timeline on track. Client will submit all the necessary material for the work specified in the Service Agreement within 15 days. If Client does not, the project will become inactive and recycled back into the queue without notification to prevent delays with other projects.
Other services: Client will clearly state the work required and be available to respond to emails within two days to approve requested updates and changes. Delay in responses of more than two days, the work is recycled back in to the queue to prevent delays with other projects.
content: text & graphics
The Client is responsibie to ensure that there are no spelling or grammatical errors contained in the final text. ASD is not responsible or held liable for any errors after the final text is posted in view of the public, nor does ASD attempt to verify the information or the content provided by Client.
Client will provide photographs for website content purposes in digital or printed format. ASD will research appropriate photographs at Client’s request. Current hourly rates, plus the cost of stock photography will apply.
support
Website (re)design: Client receives email support for 30 days after web site is provided to Client. Client will use this time to upload their content, images, and/or products and process several test entries to become familiar with the functionality of their web site. ASD provides fixes to problems experienced by the core design and excludes problems reported after 30 days and if Client modified the original files, at which time there will be a charge for hourly support.
legalese
ASD attempts to ensure the completed web site (re)design and scripts or programs used are free of errors and work with the latest browsers versions; Internet Explorer, Mozilla Firefox, etc. ASD does not guarantee the functions contained in the completed web site (re)designs will always be error-free. ASD cannot be liable to Client or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate the web site.
assignment of project
ASD reserves the right to assign other web designers or subcontractors to this project to ensure the right fit for the job as well as on-time completion.
copyrights, trademarks & licensing
Client unconditionally guarantees that elements of text, graphics, photos, designs, trademarks or other artwork provided to ASD for inclusion in Client’s web site are owned by Client, or Client has permission to use them.
Upon final payment for web site (re)design, copyright is automatically assigned as follows:
• Client owns the graphics and other visual elements ASD created for this project. ASD will give you a copy of all files and you should store them safely as ASD is not required to keep them or provide any native source files used to create them.• Client owns text content, photographs and other data provided, unless someone else owns them. ASD retains ownership of the XHTML markup, CSS and other code and it is licensed to Client for use on only the project indicated at the time of the order.
• ASD and its subcontractors retain the right to display graphics and other web design elements as examples of their work in their respective portfolios. As part of these terms of service, a credit link {site: ASD} must remain intact for the duration of the design usage.
privacy
All correspondence and documents provided will be treated as confidential between Client and ASD unless consent has been granted by both parties involved.
payments
ASD accepts checks, money orders or major credit cards through PayPal or Square in US funds only. PayPal or Square may require a nominal service charge.
waiting list aka design queue
Client pays a deposit, purchases a Pre Pay Plan, or is invoiced for hourly work, Client is placed at the end of the queue. As current projects are completed, ASD goes through the queue and contacts the next Client to start the project. Either work will begin or ASD will move to the next client in the queue.
Web site (re)designs: Receipt of the deposit secures your place in the design queue. Rush service is available for an additional fee to move Client ahead of the next project.
Web Site Updates: Prepay hours are available monthly or yearly to retain ASD for web site updates, maintenance, coding and/or design work. Payment must be received before any work begins. Work begins with the first block of time that opens in the queue. For most work, turn around time is usually between 3 to 5 days.

refunds & cancellations
Due to the nature of the services offered, ASD does not issue refunds for any reason.
If Client cancels or postpones a project, all monies paid is retained by ASD and if applicable, Client will pay a fee for all work completed beyond what was already paid.
